By accessing or using any website or service operated by the AI Digital Helper Group, including:

— or the social media management platform at booking.aidigitalhelper.com (collectively the "Service") — you agree to be bound by these Terms of Service. If you do not agree, please do not use the Service.

1. Description of Service

The AI Digital Helper Group provides a software-as-a-service platform that allows users to schedule, publish, and manage content across social media platforms including Facebook, Instagram, Threads, X/Twitter, LinkedIn, YouTube, TikTok, and others (the "Service"). The platform is operated under three associated brands: AI Digital Helper, Tamil Australia, and Digital Life Stream.

2. Eligibility

You must be at least 16 years old and have the legal capacity to enter into these Terms. If you are using the Service on behalf of a business or organisation, you represent that you have authority to bind that entity to these Terms.

3. Account Registration

• You are responsible for maintaining the confidentiality of your login credentials.
• You must provide accurate and complete information when registering.
• You are responsible for all activity that occurs under your account.
• You must notify us immediately at admin@aidigitalhelper.com if you suspect unauthorised access.

4. Acceptable Use

You agree not to use the Service to:

• Publish content that violates any applicable law or regulation.
• Violate the terms of service of any connected social media platform.
• Distribute spam, malware, phishing content, or other harmful material.
• Infringe the intellectual property rights, privacy rights, or other legal rights of any third party.
• Harass, abuse, or harm any individual or group.
• Attempt to gain unauthorised access to the Service or its infrastructure.
• Upload content you do not own or do not have rights to use and distribute.

5. Connected Social Media Accounts

By connecting a social media account, you grant us permission to access and publish on that account as you instruct through the Service. You acknowledge that each social media platform has its own terms of service, and you remain responsible for compliance with those terms. We may suspend publishing if we detect a violation.

6. Subscription and Payment

• Access to the Service may require a paid subscription.
• Fees are billed in advance on a monthly or annual basis.
• All fees are non-refundable except as required by applicable law.
• We reserve the right to change pricing with 30 days' notice to registered users.

7. Content Licence, Cross-Posting & Copyright

7.1 Licence Grant

By uploading, submitting, scheduling, or publishing any content through the Service — including but not limited to photographs, videos, text posts, captions, stories, reels, graphics, logos, or any other media (collectively "User Content") — you grant the AI Digital Helper Group (AI Digital Helper, Tamil Australia, and Digital Life Stream) a worldwide, royalty-free, perpetual, irrevocable, non-exclusive, sublicensable licence to:

• Use, reproduce, distribute, display, and publish your User Content;
• Modify, adapt, translate, resize, reformat, or create derivative works from your User Content;
• Cross-post and republish your User Content across all social media accounts, websites, newsletters, and digital channels operated by or associated with AI Digital Helper, Tamil Australia, and Digital Life Stream;
• Use your User Content to grow audiences, increase impressions, attract new participants, and promote the brands and services of the AI Digital Helper Group;
• Feature your User Content in marketing materials, promotional campaigns, media kits, and showcases.

7.2 Shared Copyright Upon Submission

This shared ownership applies to:

• Posts, captions, and text content published via the Service;
• Images, photographs, and graphics uploaded to the Service or media library;
• Videos, reels, stories, and other multimedia content created or uploaded through the platform;
• Any derivative works created by the AI Digital Helper Group based on your User Content.

7.3 Cross-Brand Use

The AI Digital Helper Group — comprising AI Digital Helper (aidigitalhelper.com), Tamil Australia, and Digital Life Stream — may freely cross-post, repurpose, adapt, and redistribute your User Content across all three brands and their associated social media accounts, websites, and digital channels, for the purpose of maximising reach, impressions, and audience engagement — without seeking additional consent for each individual use.

7.4 Moral Rights

To the maximum extent permitted by the Copyright Act 1968 (Cth) and any other applicable law, you waive all moral rights (including rights of attribution and integrity) in User Content in connection with the uses described in this Section 7. Where waiver is not permitted, you consent to the AI Digital Helper Group making use of your content consistent with these Terms without attribution in all cases.

7.5 Your Representations

You represent and warrant that:

• You own or have all necessary rights, licences, and permissions to grant the rights described in this Section 7;
• Your User Content does not infringe the intellectual property rights, privacy rights, or other legal rights of any third party;
• You have obtained all necessary consents from any individuals depicted or referenced in your User Content;
• Your User Content complies with all applicable laws and regulations.

7.6 Your Right to Delete

Notwithstanding the shared copyright and licence described above, you retain the right to request deletion of your User Content from our platform systems. Upon a verified deletion request:

• We will remove your User Content from our database and media library within 30 days;
• Content already published to third-party social media platforms (Facebook, Instagram, etc.) cannot be retroactively removed by us — you must delete those posts directly on each platform;
• The shared copyright and licence granted to the AI Digital Helper Group in already-published, distributed, or incorporated content survives deletion from our platform and remains in effect for content that has already been used or distributed.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT PUBLISHED CONTENT WILL REACH ITS INTENDED AUDIENCE. SOCIAL MEDIA PLATFORM POLICY CHANGES MAY AFFECT SERVICE FUNCTIONALITY WITHOUT PRIOR NOTICE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE AI DIGITAL HELPER GROUP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, INCLUDING LOSS OF DATA, LOSS OF REVENUE, OR LOSS OF BUSINESS OPPORTUNITY.

10. Termination

Either party may terminate the agreement at any time. Upon termination, your access to the Service will cease and we will delete your personal data within 30 days unless required by law to retain it, subject to Section 7.6 regarding User Content. You may request earlier deletion at our Data Deletion page.

11. Governing Law

These Terms are governed by the laws of New South Wales, Australia. Any disputes shall be resolved in the courts of New South Wales. Nothing in these Terms limits your rights under the Australian Consumer Law.

12. Changes to These Terms

We may update these Terms from time to time. We will notify registered users by email for material changes and update the "Last updated" date above. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.
